These terms are the agreement between you and Fooca when you use the app at fooca.pages.dev. They are short on purpose. If you use Fooca, you accept them.

Who can use Fooca
You must be 18 or older. The AI service Fooca relies on does not allow use by minors.
What Fooca is, and what it is not
Fooca estimates the calories and macronutrients in a meal from a photo or a voice note. An AI model names the foods and estimates their weight, and the calories come from the USDA FoodData Central database. Every result is an estimate, which is why Fooca shows a likely range and lets you correct it.
Fooca is not a medical device and does not give medical or nutritional advice. Its numbers can be wrong: the AI can misidentify a food or misjudge a portion, and a photo cannot show everything on the plate. Check what matters to you, and do not rely on Fooca for a medical decision, a medical diet or a condition such as diabetes or an eating disorder. For those, talk to a health professional.
The free plan
The free plan is free, needs no account and includes 10 analyses a day. We may change these limits, or the features of the free plan, over time.
Your meal log is stored only on your device (see the privacy policy). We cannot recover it if you clear your browser's data, uninstall the app or lose your phone, and your browser may delete it on its own after a long period without use. Keeping it is your responsibility.
Premium
Premium is not available yet. When it launches, its price, billing and cancellation terms will be shown before you subscribe and added to these terms. As required by Argentine consumer law, you will be able to cancel at any time from a clearly visible cancellation button, without registering again or any other step, and to withdraw from a new subscription within 10 calendar days without cost or reason.
Your photos and recordings
What you capture is yours. You let us process it only to give you the analysis, through the services listed in the privacy policy. We do not keep it, and we do not use it for anything else.
Only capture meals. Do not use Fooca to send images or recordings of other people without their permission, or anything illegal, and do not use it in ways that break Google's Generative AI Prohibited Use Policy.
Fair use
Do not try to get around the daily limit, call our server from anything other than the app, scrape it, overload it, or interfere with how Fooca works for anyone else. We may block access that does.
Ours and others'
The Fooca name, logo, design and code belong to us. The nutrition data comes from USDA FoodData Central, which the United States Department of Agriculture publishes in the public domain.
Availability
We work to keep Fooca running, but it depends on outside services (the AI providers and our hosting) and may be slow, unavailable or change without notice. We may update, suspend or stop the service.
Liability
Fooca is provided as it is. To the extent the law allows, we are not liable for decisions you make based on its estimates, or for the loss of data stored on your device. Nothing in these terms limits the rights you have as a consumer under Argentine law (Ley 24.240) or the law of the country where you live.
Changes to these terms
If we change these terms we will update the date at the top. If a change matters, we will tell you in the app before it takes effect. If you keep using Fooca after that, you accept the new terms.
Law and disputes
These terms are governed by the laws of the Argentine Republic. If you are a consumer, you may bring a claim before the courts of your own domicile.

Qué es Fooca, y qué no es
Fooca estima las calorías y los macronutrientes de una comida a partir de una foto o una nota de voz. Un modelo de IA nombra los alimentos y estima su peso, y las calorías salen de la base de datos FoodData Central del USDA. Todo resultado es una estimación; por eso Fooca muestra un rango probable y te deja corregirlo.
Fooca no es un dispositivo médico y no da consejos médicos ni nutricionales. Sus números pueden estar mal: la IA puede confundir un alimento o calcular mal una porción, y una foto no muestra todo lo que hay en el plato. Revisá lo que te importe, y no uses Fooca para tomar una decisión médica, para seguir una dieta médica ni para una condición como la diabetes o un trastorno alimentario. Para eso, consultá a un profesional de la salud.
El plan gratuito
El plan gratuito es gratis, no necesita cuenta e incluye 10 análisis por día. Podemos cambiar estos límites, o las funciones del plan gratuito, con el tiempo.
Tu registro de comidas se guarda solo en tu dispositivo (ver la política de privacidad). No podemos recuperarlo si borrás los datos del navegador, desinstalás la app o perdés el teléfono, y tu navegador puede borrarlo por su cuenta tras un período largo sin uso. Conservarlo es tu responsabilidad.
Premium
Premium todavía no está disponible. Cuando se lance, su precio y sus condiciones de cobro y de baja se van a mostrar antes de que te suscribas y se van a agregar a estos términos. Como exige la ley argentina de defensa del consumidor, vas a poder darte de baja en cualquier momento desde un botón de baja bien visible, sin volver a registrarte ni hacer ningún otro trámite, y arrepentirte de una suscripción nueva dentro de los 10 días corridos, sin costo y sin dar motivos.
Tus fotos y grabaciones
Lo que capturás es tuyo. Nos permitís procesarlo solo para darte el análisis, a través de los servicios que figuran en la política de privacidad. No lo conservamos y no lo usamos para nada más.
No intentes saltear el límite diario, llamar a nuestro servidor desde algo que no sea la app, extraer sus datos de forma automatizada, sobrecargarlo ni interferir con el funcionamiento de Fooca para otras personas. Podemos bloquear el acceso que lo haga.
Lo nuestro y lo de otros
El nombre, el logo, el diseño y el código de Fooca nos pertenecen. Los datos nutricionales provienen de FoodData Central, que el Departamento de Agricultura de los Estados Unidos (USDA) publica en el dominio público.
Disponibilidad
Trabajamos para que Fooca funcione, pero depende de servicios externos (los proveedores de IA y nuestro hosting) y puede estar lento, no disponible o cambiar sin aviso. Podemos actualizar, suspender o discontinuar el servicio.
Responsabilidad
Fooca se ofrece tal como es. En la medida en que la ley lo permita, no somos responsables por las decisiones que tomes en base a sus estimaciones, ni por la pérdida de los datos guardados en tu dispositivo. Nada de estos términos limita los derechos que tenés como consumidor según la Ley 24.240 de Defensa del Consumidor o la ley del país donde vivís.
Cambios en estos términos
Si cambiamos estos términos, vamos a actualizar la fecha de arriba. Si el cambio es importante, te lo vamos a avisar en la app antes de que entre en vigencia. Si seguís usando Fooca después de eso, aceptás los nuevos términos.
Ley aplicable y conflictos
Estos términos se rigen por las leyes de la República Argentina. Si sos consumidor, podés hacer tu reclamo ante los tribunales de tu propio domicilio.
